Official Rules

Romance Conventions Inc The “RomCon 2011 Sweepstakes” Official Rules NO PURCHASE OR SURVEY COMPLETION NECESSARY TO ENTER OR TO WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. I. SWEEPSTAKES PERIOD: The “RomCon 2011 Sweepstakes” (the “Sweepstakes”) begins on Tuesday, January 25, 2011, at 12:00:01 AM Eastern Daylight Standard Time (“ET”) and ends on Wednesday, June 15, 2011, at 11:59:59 PM. ET (the “Sweepstakes Period”). The computer clock of Sponsor’s webmaster is the official timekeeping device of the Sweepstakes. II. ELIGIBILITY: The Sweepstakes is open to legal residents of the 50 United States and District of Columbia (“D.C.”), who are at eighteen years of age or older (19 or older if a resident of AL or NE and 21 in MS) at time of entry. Officers, directors and employees of Romance Conventions Inc, (“Sponsor”) its parent company, divisions, subsidiaries and affiliates, Compliance Sweepstakes Services LLC, and the agents, advertising, promotional and judging agencies of each of the foregoing, and any other entity or persons that develops, produces or distributes materials for or related to this Sweepstakes (collectively, the "Sweepstakes Entities"), and members of the immediate families (defined for these purposes as including parents, grandparents, children, grandchildren, siblings, and each of their respective spouse) or households (whether related or not) of any of the above, are NOT eligible to enter or win. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations, and is void outside the 50 United States and D.C. and where prohibited by law. Winning a prize is contingent upon fulfilling all requirements set forth herein. III. HOW TO ENTER THE SWEEPSTAKES: To Enter Online: Go to www.romcon2011.com (the “Web Site”) during the Sweepstakes Period. Follow the onscreen instructions. Complete the survey (completion expected to take no more than 5 minutes) and the registration form. Upon completion you will be automatically entered into the Sweepstakes. To Enter by Mail: Legibly handprint or type: your full name, date of birth, street address, city, state, zip code, daytime phone number and email address (if any) on a 3”x 5” card and mail in an appropriate mailer or envelope with sufficient first class postage affixed to: RomCon 2011 Sweepstakes, 90 Rockwood Pl, Rochester, NY, 14610. All mail in entries must be postmarked by the June 15, 2011 and received by June 29, 2011. By entering, you acknowledge compliance with, these Official Rules including all eligibility requirements, and the terms of use of the Web Site, as applicable. Sponsor reserves the right to disqualify any entry that it determines, in its sole discretion, has violated any provision of these Official Rules or the Web Site’s terms of use at http://romconinc.com/romcon2011/index.html (see Website Legal Notice for completeterms), as applicable, and its decisions in this regard are final. Proof that you completed the survey, entered the Sweepstakes online or submitted an entry by mail does not constitute evidence that we actually received it by the appropriate deadline. Entrants waive all rights and remedies at law or in equity for any claim they may have relating to this Sweepstakes. Incomplete and/or illegible entries are void. Limit one entry per person, regardless of method of entry. Should multiple entries be received, all such entries will be ineligible. All entries become the property of Sponsor and will not be acknowledged or returned. IV. WINNER DRAWING, NOTIFICATION AND ODDS: On or about June 21, 2011, One (1) potential Grand Prize Winner, Three (3) potential Second Prize Winners and Five (5) Third Prize Winners will be chosen by a random drawing of all eligible entries received during the applicable Sweepstakes, by the independent Sweepstakes Administrator, whose decisions are final and binding on all matters relating to the drawings. The potential winners will be notified by phone or e-mail on or about June 21, 2011. Odds of winning will depend upon the number of eligible entries received during the Sweepstakes Period. Each potential winner will be required to execute and return an Affidavit of Eligibility and Liability/Publicity Release within five (5) days of Sweepstakes Administrator’s first attempted notification of the prize or that potential winner will be disqualified and an alternate potential winner selected based on the criteria herein. Return of any prize as undeliverable will similarly disqualify that potential winner and an alternate potential winner will be selected based on the criteria herein. Sweepstakes winners may be featured on the Sponsor's Web Site. V. PRIZES •One (1) One Grand Prize Winner will be awarded a four day / three night trip for two to Denver Colorado for the RomCon 2011 convention event August 5, 2011 to August 7, 2011. Prize includes: two (2) airfare tickets ($800); hotel for 3 nights ($450); convention registrations for 2 ($300), meals for 2 ($240), the Borders gift basket ($200) Approximate Retail Value (“ARV”) of Total of Grand Prize is $1,990.00 • Three (3) Second Prize Winners will each receive One (1) Ticket to the August 5, 2011 to August 7, 2001RomCon 2011 convention event, brunch, a Borders $50 Gift Card and a Borders E-Reader. ARV of Second Prize is $375.00 Total ARV of Second Prize is $1,125.00 • Five (5) Third Prize Winners will each receive One (1) Ticket to the August 5, 2011 to August 7, 2001RomCon 2011 convention event and a $20 Borders Gift Card. ARV of Third Prize is $170.00. Total ARV of Third Prize is $850.00 Total ARV of all prizes in this Sweepstakes is $3,965.00. Event prize must be executed on dates of the RomCon Convention, August 5 – August 7, 2011. VI. TRIP & TICKET PRIZE CONDTIONS: The prize must be executed on dates of the RomCon Convention event, August 7 – August 9, 2011. The winner agrees to accept the travel dates specified in the Sponsor’s event schedule. If the winner cannot travel on such dates, the prize will be forfeited. All travel arrangements will be made through a travel agent selected by Sponsor. While prize suppliers will make every effort to confirm reservations as requested, operational and/or market conditions may prevent them from doing so on the requested dates. The Grand Prize Winner will receive two economy class tickets from a major airport nearest the winner’s U.S. residence as determined by Sponsor in its sole discretion. Airfare ticket cannot exceed the $400 designated price point. The Winner, who lives within a 200-mile radius of the designation, will not receive the air transportation portion of the prize, but a $350 travel allowance. The prize package also includes standard hotel accommodations (one room/double occupancy). The Prize awarded consisting of products/services for two people require that the winner and their companion redeem the prize together. It is each winner’s sole responsibility for winner and any guest to obtain and travel with the required documents. Winner and travel companion must execute liability/publicity release and travel companion waiver prior to issuance of travel documents. Companion of winner must be at least eighteen (18) years of age as of the date of departure. If travel companion is a minor, parent or legal guardian must sign and return release, as well as accompany minor on trip. Sponsor will not replace any lost, mutilated, or stolen travel vouchers or certificates. Once travel commences, no stopovers are permitted; if stopover occurs, full fare will be charged from stopover point for the remaining segments, including return, of the trip. All local, state and federal taxes are the sole responsibility of winner. Travel restrictions, conditions and limitations may apply. The prize is subject to availability, advance reservations and other restrictions, including state, local and federal laws and limitations that may apply. Each winner will be responsible for all tips, gratuities, service charges, taxes, meals, ground transportation not specified, hotel room service, laundry service, alcoholic beverages, merchandise, souvenirs, local and long-distance telephone calls, site-seeing excursions and any other incidental costs or expenses not identified in these Official Rules. Additional prize award details and travel information to be provided to the winner at the time of trip arrangements. The winner may be required to provide a credit card at the time of hotel check-in. The total value of the airfare, hotel accommodations, and event cannot exceed $1,990. Trip may not be combined with any other offer and travel may not qualify for frequent flyer miles. Sponsor is not responsible for cancellation or preemption of the event or for other circumstances that make it impractical or impossible to fulfill these elements of the prize. Sponsor reserves the right, at its sole discretion, to substitute any prize package with another prize of equal or greater value in the event that the advertised prize (or any component thereof) is not available. All decisions by Sponsor as to prizewinners and prizes are final. All local, state and federal taxes are the sole responsibility of winner. The Prize package is not exchangeable, transferable, or redeemable for cash. There are no substitutions unless specified by the Sponsor. The RomCon trip prize and convention event must be accepted and used according to Romance Convention Inc’s event scheduled dates or prize will be forfeited and an alternative winner will be chosen. The Approximate Retail Value (“ARV”) of Grand Prize is $1,990.00. VII. ALL PRIZE TERMS AND CONDITIONS: All winners are required to comply with any and all applicable federal, state and local laws, rules and regulations. The stated “ARV” of the prizes is based on available information provided to Sponsor at the time these Official Rules were drafted (and any difference in ARV at the time of awarding will not be awarded) and the value of any prize awarded to a winner may be reported for tax purposes as required by law. The prizewinners will be solely responsible for all federal, state and/or local taxes, and for any other fees or costs associated with the prize they receive. The winners receiving a prize valued over $600.00 will be required to sign the Affidavit, and return it within five (5) days of notification. Prizewinners may also be required to send a copy of their passport, driver’s license or birth certificate as proof of age. A winner may be required to provide Sponsor with a valid social security number before a prize will be awarded for tax reporting purposes. An IRS Form 1099 will be issued in the name of a Winner. Non-compliance may result in disqualification. If any potential prize winner fails or refuses to sign and return such Affidavit within the time period required by Sponsor or if the prize or prize notification is returned as rejected, faulty, unclaimed or returned as undeliverable to such potential prize winner, such potential prize winner may be disqualified and an alternate may be selected. Non-compliance shall result in disqualification and award of the prize to an alternate winner. If any potential prize winner is found to be ineligible, or if he or she has not complied with these Official Rules, or if the potential prize winner cannot attend or participate in any portion of the prize, or declines a prize for any reason prior to award, such potential winner may be disqualified and an alternate potential winner may be selected. If, for any reason, more bona fide winners come forward seeking to claim prizes in excess of the number of each type of prize set forth in these Official Rules, the winners, or remaining winners, as the case may be, of the advertised number of prizes available may be selected in a random drawing from among all persons making purportedly valid claims for such prize(s). Inclusion in such drawing shall be each entrant’s sole and exclusive remedy under such circumstances. The Sweepstakes Entities are not responsible for and shall not be liable for late, lost, damaged, intercepted, misdirected, or unsuccessful efforts to notify the potential winners. All properly claimed prizes will be awarded. The Sponsor and its agents are not in any way responsible or liable for damages resulting from shipping and handling, loss, use or misuse of any prize awarded in this Sweepstakes. Each winner’s acceptance of a prize constitutes permission (except where prohibited) for the Sponsor to use the winner’s name, photograph, likeness, statements, biographical information, voice and address (city and state) for any and all public relations, advertising and/or promotional purposes as determined by Sponsor, in all forms of media and by all manners (now and hereafter known), in perpetuity, without notice, consent, review or approval or further compensation. VIII. ENTRY ERRORS/TAMPERING Sponsor is not responsible for: (i) electronic or digital transmissions or any entries that are lost, late, stolen, incomplete, illegible, damaged, garbled, destroyed, postage-due or misdirected; (ii) any problems or technical malfunctions, errors, omissions, interruptions, deletions, defects, delays in operation or transmission, communication failures, destruction or unauthorized access to, or alteration of, entries; (iii) failed or unavailable hardware, network, software or telephone transmissions, damage to entrants’ or any person’s computer and/or its contents, or causes beyond Sponsor’s reasonable control that jeopardize the administration, security, fairness, integrity or proper conduct of this Sweepstakes; (iv) any entries submitted in a manner that is not expressly allowed under these rules; (v) incorrect or inaccurate entry information whether caused by entrants or by any of the equipment or programming associated with or utilized in the Sweepstakes, (vi) any typographical or other error in the printing or advertising of the offer, administration or execution of the Sweepstakes, or in the announcement of prize/prize winners; or (vii) malfunctions or interference resulting from illicit, malicious or injurious code (including but not limited to viruses, worms and denial of service attacks). If for any reason the Sweepstakes cannot be executed as planned, including but not limited to transmission failure, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor that corrupt or affect the security, administration, fairness, integrity or proper conduct of the Sweepstakes, or if the Sweepstakes is compromised or becomes technically corrupted in any way, electronically or otherwise, Sponsor reserves the right to cancel, modify or terminate the Sweepstakes and reserves the right, but shall not be obligated, to randomly select the winners from among all non-suspect entries received as of the date/time of such termination/cancellation or modification. Sponsor reserves the right, at its sole discretion, to disqualify and prosecute any individual who tampers with or attempts to tamper with the entry process or who enters using any automatic or programmed entry duplication method. CAUTION: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEB SITE OR OTHERWISE CORRUPT THE SWEEPSTAKES OR TO UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO DISQUALIFY, PROSECUTE AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor reserves the right to void all entries made through any robotic, automatic, mechanical, programmed or similar entry duplication method and to disqualify any individual using such a method. Any entrant determined to be involved in such prohibited activity will not be eligible to receive a prize in this Sweepstakes. IX. RELEASES: Except where prohibited by law, acceptance of a prize constitutes winner’s agreement to hold harmless Sponsor, Compliance Sweepstakes Services LLC, their parents, affiliates and subsidiary companies, advertising and promotion agencies, and the officers, directors, employees and agents of each of them (individually and collectively for the purposes of this paragraph, “Sweepstakes Entities”) from and against any injuries, losses or damages arising in any way from or in connection with their participation in this Sweepstakes, the acceptance, possession or use of the prize, Sweepstakes Entities’ reliance upon winner’s compliance with these Official Rules, or winner’s participation in prize related activities, and further constitutes winner’s agreement that the Sweepstakes Entities may use winner’s name, voice, likeness and/or biographical data for advertising and promotional purposes in any and all media worldwide without limitation or additional compensation. X. GOVERNING LAW/DISPUTES: Except where prohibited, each entrant agrees that this Sweepstakes shall be governed by and construed in accordance with, the laws of the State of Colorado, without giving effect to any choice of law or conflict of law rules. Sponsor reserves the right to take such action as it deems necessary to enforce these Official Rules and ensure the fair operation of the Sweepstakes, including without limitation barring entrants who do not comply with these Official Rules. By entering, entrants consent to the jurisdiction and venue of the appropriate federal, state and local courts located in Colorado for any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded. XI. Sponsor’s failure to enforce any term of these Official Rules will not constitute a waiver of that provision. For Participant, to the extent there is a conflict between Official Rules appearing any other location and any terms of use or other agreements posted on the Sponsor's Web Site, these are the Official Rules to be abided by.
